BuildKnack Terms & Conditions

1. Introduction

Welcome to BuildKnack.

These Terms & Conditions ("Terms") govern your access to and use of the BuildKnack mobile application, related services, websites, and any associated features (collectively, the "Service"), which are owned and operated by Tecknack Limited ("Tecknack", "we", "our", or "us").

BuildKnack is designed to assist builders, contractors and other construction professionals by providing AI-assisted estimate analysis together with tools for creating, editing and managing project estimates, quotations and contract documents.

By creating an account, accessing the Service, purchasing a Job Pack, or using any feature of BuildKnack, you acknowledge that you have read, understood and agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not access or use the Service.

These Terms apply to all users of the Service, including users of the lifetime free-job allowance and users who purchase one-time Job Packs.

Nothing in these Terms shall be interpreted as excluding or limiting any statutory rights that cannot legally be excluded under applicable law.

2. Definitions

In these Terms & Conditions, unless the context requires otherwise, the following words and expressions have the meanings set out below:

Account

The registered user account used to access the Service through a supported third-party authentication provider.

AI Estimate Analysis

An AI-assisted analysis generated by the Service based on information provided by the Builder, including but not limited to photographs, project descriptions and pricing information. AI Estimate Analysis is intended solely as an assistive tool and must not be relied upon without independent review.

Builder

The individual or business using the Service to create, manage or generate project estimates, quotations or contract documents.

BuildKnack

The BuildKnack mobile application, together with its associated services, features and related software provided by Tecknack Limited.

Content

Any information uploaded, entered, created or generated through the Service, including photographs, project descriptions, customer information, pricing information, estimates, quotations, contracts and other documents.

Contract

An editable document generated using templates provided within the Service to assist Builders in preparing agreements with their customers.

Customer

The individual or organisation for whom the Builder is preparing an estimate, quotation or contract.

Job

A project created within BuildKnack containing project information, photographs, estimates and related documentation.

Quote

An editable quotation generated using the Service based on information provided by the Builder.

Service

The BuildKnack mobile application, associated cloud services, AI-assisted features, websites and any other services made available by Tecknack Limited.

Job Pack

A one-time consumable in-app purchase that provides the number of additional Job credits displayed within the Service at the time of purchase.

Terms

These Terms & Conditions, including any amendments published by Tecknack Limited from time to time.

We, Us, Our

Tecknack Limited, a company registered in the United Kingdom.

You, Your

The Builder or other authorised user accessing or using the Service.

3. Eligibility

To use the Service, you must meet the eligibility requirements set out in this section.

3.1 Minimum Age

You must be at least 16 years of age to create an Account or use BuildKnack. By using the Service, you confirm that you satisfy this minimum age requirement.

3.2 Legal Capacity

You represent and warrant that you have the legal capacity and authority to enter into these Terms and, where applicable, to act on behalf of the business or organisation you represent.

3.3 Business Use

BuildKnack is intended primarily for builders, contractors and other construction professionals. If you use the Service on behalf of a business, you confirm that you have the authority to bind that business to these Terms.

3.4 Compliance with Applicable Laws

You are solely responsible for ensuring that your use of the Service, including any estimates, quotations, contracts or other documents you create, complies with all applicable laws, regulations, professional obligations and industry standards in the jurisdiction where you operate.

3.5 Restricted Use

You must not access or use the Service if doing so would violate any applicable law or regulation, or if you are prohibited from entering into legally binding agreements under the laws applicable to you.

4. Accounts & Authentication

To access certain features of the Service, you must create and maintain an Account.

4.1 Account Creation

An Account is created when you successfully sign in using one of the supported authentication providers made available within the Service.

You agree to provide accurate and up-to-date information where requested and to keep your account information current where applicable.

4.2 Authentication

BuildKnack currently supports authentication using approved third-party identity providers, including Sign in with Apple and Sign in with Google. We do not provide traditional username and password authentication.

Your authentication credentials are managed by your chosen identity provider. Tecknack Limited does not receive or store your account password.

4.3 Account Security

You are responsible for maintaining the security of the device and authentication account used to access the Service.

You must promptly notify us if you believe your Account has been accessed without your authorisation or if you become aware of any unauthorised use of the Service.

We are not responsible for any loss resulting from unauthorised access caused by your failure to adequately secure your device or authentication account.

4.4 Account Deletion

You may permanently delete your Account at any time through the settings available within the Service.

Upon account deletion, we delete your active Firebase account and associated cloud profile and allowance records, subject to the limited retention described below and in our Privacy Policy.

Most project information, including Jobs, customer information, photographs, estimates, quotations and contracts, is stored locally. Account deletion erases BuildKnack content from the device on which deletion is performed. It cannot erase content stored on another device, in a device backup, or in documents that you previously exported or shared.

4.5 Anti-Abuse Measures

To help prevent repeated claims of the lifetime free-job allowance, we retain a one-way cryptographic hash derived from your authentication provider's stable identifier for six months after account deletion.

This hash is generated using a secure server-side process and cannot reasonably be used to identify you directly.

The retained hash is used solely for fraud prevention, abuse detection and enforcement of Service usage policies. It is automatically removed after the retention period described in our Privacy Policy.

If you have unused purchased Job Pack credits when you delete your Account, we retain a pseudonymised record of the remaining balance for six months. This allows the credits to be restored if you sign in again with the same authentication account during that period. The record does not contain your email, name, Jobs, photographs or previous Firebase user ID and is removed when the balance reaches zero or the six-month period expires.

4.6 One Account Per User

You must not create or use multiple Accounts to circumvent usage allowances, promotional offers or other restrictions imposed by the Service.

We reserve the right to investigate suspected misuse and to suspend or terminate Accounts where we reasonably believe these Terms have been violated.

5. Job Packs & Fair Use

BuildKnack provides a lifetime free-job allowance and offers one-time consumable Job Packs. The Job Packs available to you, together with their current credit quantities, features and prices, are displayed within the Service at the time of purchase.

5.1 Usage Allowances

Depending on the applicable allowance, the Service may limit the number of Jobs, photographs submitted for Job analysis, analyses per Job, or other Service functionality.

The current limits displayed within the Service form part of the applicable free allowance or Job Pack.

5.2 Job Usage

A Job credit may be reserved when you create a Job. If you permanently delete a paid Job before any successful Job analysis has been performed, the reserved Job Pack credit may be returned. Once a successful Job analysis has been performed, deleting the Job does not restore the consumed credit.

Additional credit and allowance rules displayed within the Service at the time you create or delete a Job also apply.

5.3 Fair Use

You agree to use the Service fairly and only for its intended purpose.

You must not attempt to circumvent usage limits, create multiple Accounts to obtain additional free usage, manipulate usage counters or otherwise interfere with the operation of the Service.

We reserve the right to investigate suspected abuse and to restrict, suspend or terminate access where we reasonably believe the Service is being misused.

5.4 One-Time Purchases

Job Packs are one-time consumable purchases and do not renew automatically. You may purchase another Job Pack when you need additional Job credits.

5.5 Expiry of Allowances

Unused purchased Job Pack credits do not expire while your Account remains active. If you delete your Account, unused credits may be restored for up to six months as described in Section 4.5 and the Privacy Policy; after that period, the restoration record is permanently deleted.

5.6 Changes to Plans

We may introduce, modify or discontinue Job Packs, usage allowances, pricing or Service features from time to time.

Changes will not remove Job credits that you have already purchased, except where credits are removed following a refund, chargeback, account deletion and expiry of the six-month restoration period, or as otherwise required by law.

Any changes will apply only in accordance with applicable consumer protection laws and the billing policies of the relevant app store.

6. Payments, Billing & Refunds

Certain usage allowances require the purchase of a Job Pack. Details of available Job Packs, pricing and features are displayed within the Service at the time of purchase.

6.1 Payment Processing

All purchases made through the BuildKnack mobile application are processed using the payment systems provided by the relevant app store, including the Apple App Store and Google Play.

Purchase validation and Job-credit management are facilitated by RevenueCat. Payment information is processed by the relevant app store and is not stored by Tecknack Limited.

6.2 Billing

By purchasing a Job Pack, you authorise the relevant app store to charge the applicable fees, taxes and other charges associated with your purchase.

Applicable taxes, where required by law, may be included in or added to the purchase price depending on your location and the billing policies of the relevant app store.

6.3 No Automatic Renewal

Job Packs are consumable one-time purchases. They do not renew automatically and do not create a recurring payment obligation.

6.4 Account Deletion

Deleting your BuildKnack Account does not automatically refund a completed Job Pack purchase. Unused credits are handled as described in Sections 4.5 and 5.5.

6.5 Refunds

Refund requests for purchases made through the Apple App Store or Google Play are generally governed by the refund policies of the relevant app store.

Tecknack Limited does not control the approval or processing of refunds for purchases made through those platforms.

6.6 Failed Payments

If a payment cannot be successfully processed or is later refunded or charged back, the related Job credits may not be granted or may be removed, subject to applicable law and app-store rules.

6.7 Changes to Pricing

We may change the pricing of our plans or introduce new plans from time to time.

A price change will apply to future purchases and will not alter the price of a Job Pack that you have already completed purchasing.

7. Jobs

The Service enables Builders to create and manage individual project records ("Jobs") for the purpose of preparing estimates, quotations and contract documents.

7.1 Creating Jobs

A Job may include information such as project descriptions, photographs, customer information, pricing information, notes and other project-related content provided by the Builder.

You are solely responsible for ensuring that all information entered into a Job is accurate, complete and lawful.

7.2 Customer Information

Where you choose to enter customer information into a Job, you confirm that you have the necessary rights and legal basis to collect, use and process that information for your business purposes.

You remain solely responsible for complying with all applicable data protection and privacy laws relating to your customers.

7.3 Project Content

You retain ownership of the information, photographs and other Content that you upload or create within your Jobs.

You grant Tecknack Limited a limited, non-exclusive licence to process such Content only to the extent necessary to provide the Service requested by you, including AI Estimate Analysis, cloud functionality and technical support where applicable.

7.4 Local Storage

Unless otherwise stated within the Service, Job information is primarily stored locally on your device.

You are responsible for protecting your device and maintaining any backups you consider necessary. Tecknack Limited is not responsible for the loss of locally stored information resulting from device failure, loss, theft, damage, factory reset or other events outside our reasonable control.

7.5 Availability of Jobs

Access to Jobs and related features may depend on your current plan, available usage allowances and the continued operation of the Service.

We may introduce new Job-related features, modify existing functionality or discontinue certain features as part of the ongoing development of the Service.

7.6 Builder Responsibility

BuildKnack is a productivity tool intended to assist Builders in organising project information and preparing documents.

You remain solely responsible for verifying the accuracy of all project information, customer details, pricing, estimates, quotations and contracts created from any Job before relying on them or sharing them with third parties.

8. AI Estimate Analysis

BuildKnack includes AI-assisted functionality designed to help Builders analyse project information and prepare preliminary estimates more efficiently. AI Estimate Analysis is intended solely as an assistive tool and does not replace the Builder's own professional knowledge, judgement or experience.

8.1 Requesting AI Estimate Analysis

When you request an AI Estimate Analysis, the Service processes the information you choose to provide for that Job. This may include photographs, project descriptions, pricing information, Builder rates and other relevant project details necessary to generate the requested analysis.

By requesting an AI Estimate Analysis, you authorise Tecknack Limited to process this information using trusted third-party AI service providers solely for the purpose of generating the requested analysis and providing the Service.

8.2 AI-Generated Results

AI Estimate Analysis is generated automatically using artificial intelligence technologies. The results are based solely on the information provided and the capabilities of the underlying AI systems at the time the request is processed.

AI-generated content may contain inaccuracies, omissions, incorrect assumptions or incomplete recommendations. Hidden defects, structural issues, site conditions and other project-specific factors may not be identified from the information supplied.

8.3 Builder Review Required

You are solely responsible for reviewing every AI Estimate Analysis before relying upon it.

Before preparing or issuing any estimate, quotation or contract, you should carefully review the AI-generated results and make any additions, deletions or corrections necessary to reflect the actual project requirements.

The Service allows you to edit AI-generated information before creating customer-facing documents. You acknowledge that this review process is an essential part of using the Service.

8.4 No Professional Advice

AI Estimate Analysis does not constitute legal, engineering, surveying, architectural, quantity surveying, financial, insurance or other professional advice.

Nothing generated by the Service should be treated as a substitute for professional judgement, site inspections or independent verification.

8.5 Continuous Improvement

We may improve, update, replace or modify AI functionality from time to time in order to enhance the Service.

Such improvements may affect the format, content, accuracy or functionality of AI Estimate Analysis without altering the fundamental purpose of the Service.

9. Quotes

BuildKnack enables Builders to generate editable quotation documents based on the information contained within a Job, including project details, pricing information and AI Estimate Analysis where applicable.

9.1 Quote Generation

Quotes are generated using templates provided by the Service together with information entered or approved by the Builder.

The generated Quote is intended to assist the Builder in preparing a professional quotation for a Customer and may be edited before it is exported, saved or shared.

9.2 Builder Control

You retain full control over the content of every Quote created using the Service.

You may modify, add, remove or reorganise any part of a Quote at any time before it is issued to a Customer.

9.3 Accuracy of Quotes

You are solely responsible for ensuring that every Quote accurately reflects the work to be performed, the materials required, pricing, labour costs, exclusions, timescales and any other commercial terms applicable to your project.

You should carefully review all information before providing a Quote to a Customer.

9.4 Ownership

Quotes generated through the Service remain your Content.

Tecknack Limited does not claim ownership of your Quotes or the commercial information contained within them.

9.5 Customer Communication

Any Quote issued to a Customer is sent on your behalf and under your sole responsibility.

You are solely responsible for deciding whether to issue, amend or withdraw any Quote created using the Service.

10. Contracts

BuildKnack enables Builders to generate editable Contract documents using templates provided within the Service together with information contained in a Job.

10.1 Contract Templates

Contract templates are provided solely to assist Builders in preparing project documentation more efficiently. They are intended as editable starting points and are not customised legal documents.

The templates are provided for convenience only and may not be suitable for every project, business, Customer or jurisdiction.

10.2 Builder Review Required

You are solely responsible for reviewing, editing and approving every Contract before it is presented to or shared with a Customer.

You should ensure that the Contract accurately reflects the agreed scope of work, pricing, payment terms, project requirements and any other contractual terms relevant to the project.

10.3 Legal Compliance

You are solely responsible for ensuring that every Contract complies with all applicable laws, regulations, consumer protection requirements and industry standards in the jurisdiction where the work will be carried out.

If necessary, you should obtain independent legal advice before relying upon or issuing any Contract generated using the Service.

10.4 No Legal Review

Contracts generated through the Service are not reviewed, approved or certified by a solicitor, lawyer or other legal professional.

Tecknack Limited does not verify the legal accuracy, enforceability, completeness or suitability of any Contract generated using the Service.

10.5 No Electronic Execution

The Service does not provide electronic signature functionality, digital witnessing or legal execution services.

Any signing, acceptance or execution of a Contract takes place entirely outside the Service and remains solely the responsibility of the Builder and the Customer.

10.6 Ownership

Contracts created using the Service remain your Content.

Tecknack Limited does not claim ownership of your Contracts or the commercial information they contain.

11. User Responsibilities

As a Builder using the Service, you are responsible for ensuring that your use of BuildKnack is lawful, accurate and appropriate for your business activities.

11.1 Accurate Information

You are responsible for ensuring that all information entered into the Service, including project details, photographs, customer information, pricing, rates and other Content, is accurate, complete and up to date.

11.2 Review of AI Estimate Analysis

You must independently review every AI Estimate Analysis before relying on it for estimating work, preparing quotations or generating Contracts.

You should amend, remove or add information wherever necessary to ensure the final documents accurately reflect the actual project requirements.

11.3 Quotes and Contracts

You are solely responsible for every Quote and Contract that you generate, edit, issue or otherwise provide to a Customer.

You must ensure that all documents are suitable for the intended project and comply with applicable legal, contractual and regulatory requirements.

11.4 Customer Information

You are responsible for obtaining and processing Customer information in accordance with applicable privacy and data protection laws.

You confirm that you have the necessary authority and lawful basis to enter Customer information into the Service.

11.5 Compliance with Laws

You are solely responsible for complying with all applicable laws, regulations, licensing requirements, professional obligations and industry standards relating to your business and the work you undertake.

11.6 Device Security

You are responsible for maintaining the security of your mobile device and any authentication accounts used to access the Service.

You should take reasonable steps to prevent unauthorised access to your Account and locally stored project information.

11.7 Backups

Where locally stored information is important to your business, you are responsible for maintaining appropriate backups or other records.

Tecknack Limited is not responsible for the loss of locally stored information caused by device failure, damage, loss, theft or other circumstances outside our reasonable control.

11.8 Lawful Use

You must use the Service only for lawful purposes and in accordance with these Terms.

You remain solely responsible for all activities carried out using your Account.

12. Acceptable Use

You agree to use the Service responsibly, lawfully and only for its intended purpose.

12.1 Permitted Use

The Service is provided to assist Builders in preparing project estimates, quotations and contract documentation. You may use the Service only in accordance with these Terms and all applicable laws and regulations.

12.2 Prohibited Activities

You must not:

• use the Service for any unlawful, fraudulent or misleading purpose;
• submit false, inaccurate or intentionally misleading information;
• attempt to bypass usage allowances or other Service limitations;
• create multiple Accounts for the purpose of circumventing plan restrictions or promotional offers;
• attempt to interfere with, disrupt or compromise the security, availability or integrity of the Service;
• reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Service except where such restriction is prohibited by applicable law;
• upload or transmit malicious software, viruses, harmful code or other material intended to damage or disrupt the Service;
• use the Service in a manner that infringes the intellectual property rights, privacy rights or other legal rights of any person;
• use the Service to create or distribute documents that you know are false, misleading or intended to facilitate unlawful activity;
• attempt to gain unauthorised access to any systems, servers, accounts or data relating to the Service.

12.3 Suspension for Misuse

If we reasonably believe that you have breached these Terms or used the Service in an unlawful, abusive or fraudulent manner, we may suspend or restrict your access while we investigate the matter.

Where appropriate, we may also permanently terminate your access in accordance with Section 21 (Suspension & Termination).

12.4 Compliance with Third-Party Rights

You are responsible for ensuring that any photographs, documents or other Content uploaded to the Service do not infringe the copyright, privacy, confidentiality or other legal rights of any third party.

12.5 Cooperation

You agree to cooperate with any reasonable investigation relating to suspected misuse of the Service or any breach of these Terms.

13. Data Storage

BuildKnack is designed to store much of your project information locally on your device while using secure cloud services where necessary to provide certain features of the Service.

13.1 Local Storage

Project information such as Jobs, photographs, customer information, estimates, Quotes, Contracts and other related Content may be stored locally on your device.

Locally stored information remains under your control and is your responsibility to protect.

13.2 Cloud Services

Certain information is stored or processed using secure cloud service providers in order to provide authentication, purchase and usage management, Job analysis and other essential Service functionality.

Further information about the processing of personal data is provided in our Privacy Policy.

13.3 Device Responsibility

You are responsible for maintaining access to your device and protecting it against unauthorised access.

If your device is lost, stolen, damaged, replaced or reset, locally stored information may no longer be available.

13.4 Data Recovery

Unless expressly stated within the Service, Tecknack Limited does not guarantee that locally stored project information can be recovered following device failure, accidental deletion or other events outside our reasonable control.

You are responsible for maintaining any records or backups that you consider necessary for your business.

13.5 Service Improvements

As the Service evolves, we may introduce additional cloud-based features, synchronisation capabilities or backup functionality.

The availability of such features will depend on your version of the Service, your selected plan and any applicable feature availability.

13.6 Processing of Customer Personal Data

For Customer personal data that remains only on your device, Tecknack Limited does not ordinarily receive or have access to that information. Where you submit Customer-related Content for Job analysis or another server-based feature, you act as the data controller and Tecknack Limited acts as your data processor.

The subject matter of this processing is the provision of the server-based feature you request. Processing lasts for the time needed to provide that feature and for any limited retention described in the Privacy Policy. It may involve transmitting, reviewing by automated systems, structuring and returning selected Job descriptions, location information, dimensions, labour rates, previous estimates and optional photographs. The data subjects may include your Customers, property occupants and other individuals depicted in or identifiable from the Content.

Tecknack Limited will:

• process Customer personal data only on your documented instructions, as expressed through your use of the Service and these Terms, unless processing is required by applicable law;
• ensure that persons authorised to process the data are subject to appropriate confidentiality obligations;
• apply appropriate technical and organisational security measures proportionate to the processing;
• provide reasonable assistance with data-subject requests, security incidents, data protection impact assessments and regulatory enquiries, taking account of the nature of the processing and the information available to us;
• delete or return Customer personal data at the end of the relevant processing, except where retention is required or permitted by law or is described in the Privacy Policy; and
• make available information reasonably necessary to demonstrate compliance with these processor obligations and cooperate with reasonable audits, subject to appropriate confidentiality and security arrangements.

You give Tecknack Limited general authorisation to use subprocessors necessary to provide the Service, including Google Cloud and OpenAI for Job analysis. Current provider categories and international-transfer information are identified in the Privacy Policy. We will remain responsible for imposing appropriate data protection obligations on our subprocessors and will provide appropriate notice of material changes where required by law, giving you an opportunity to object by discontinuing the affected processing feature.

14. Third-Party Services & Integrations

BuildKnack relies on third-party service providers and platform operators to deliver certain features of the Service. These providers perform functions such as authentication, cloud infrastructure, payment processing, artificial intelligence, diagnostics and platform distribution.

14.1 Third-Party Providers

The Service may utilise third-party providers including, but not limited to:

• authentication providers;
• cloud hosting and infrastructure providers;
• artificial intelligence service providers;
• payment and purchase-management providers;
• diagnostic service providers;
• mobile platform providers and app stores.

The providers used by the Service may change from time to time as the Service evolves.

14.2 Independent Services

Some third-party providers process personal data on behalf of Tecknack Limited under contractual data protection obligations. Others, including app stores and sign-in providers for some activities, may act as independent controllers under their own terms and privacy policies.

Your use of services provided directly by those third parties may also be governed by the applicable terms and policies of the relevant provider.

14.3 Availability

Certain features of BuildKnack depend upon the continued availability and proper operation of third-party services.

Temporary interruptions, delays or failures affecting third-party providers may impact some functionality of the Service.

14.4 Changes to Providers

We reserve the right to replace, add or remove third-party providers at any time where reasonably necessary to improve, maintain or operate the Service.

Such changes will not reduce your statutory rights under applicable law.

14.5 No Endorsement

Reference to any third-party service provider within the Service or these Terms does not constitute an endorsement, partnership or guarantee of that provider's products or services unless expressly stated otherwise.

15. Service Availability

We aim to provide a reliable and high-quality Service. However, BuildKnack is provided over the internet and relies on third-party infrastructure and technologies. As a result, uninterrupted or error-free availability cannot be guaranteed.

15.1 Availability

We will use reasonable efforts to keep the Service available and operating as intended. From time to time, access to some or all features may be temporarily unavailable due to maintenance, updates, technical issues or circumstances beyond our reasonable control.

15.2 Planned Maintenance

We may perform scheduled maintenance, upgrades or improvements to the Service. Where reasonably practicable, we will endeavour to minimise disruption, although advance notice may not always be possible.

15.3 Third-Party Dependencies

Certain features of the Service depend on third-party providers, internet connectivity and the proper operation of your mobile device. We are not responsible for interruptions caused by failures or unavailability of third-party services, telecommunications networks or your device.

15.4 Feature Changes

We may add, improve, modify, replace or discontinue features of the Service from time to time in order to enhance functionality, improve security, comply with legal requirements or support the ongoing development of BuildKnack.

Where required by applicable law, we will provide appropriate notice of material changes that significantly affect your use of the Service.

15.5 Force Majeure

We shall not be liable for any delay, interruption or failure to perform our obligations under these Terms where such delay or failure results from events beyond our reasonable control. These events may include, but are not limited to, natural disasters, severe weather, fire, flood, power failures, internet outages, cyber-attacks, acts of government, labour disputes, pandemics or failures of third-party infrastructure.

15.6 No Guaranteed Availability

Except where required by applicable law, we do not guarantee that the Service will always be available, uninterrupted, secure or free from errors. You acknowledge that temporary interruptions may occur as part of the normal operation and maintenance of online services.

16. AI & Estimate Disclaimer

BuildKnack uses artificial intelligence to assist Builders in analysing project information and preparing preliminary estimates. AI functionality is intended solely as a productivity tool to assist the Builder and must not be relied upon as the sole basis for commercial or professional decisions.

16.1 AI-Generated Content

AI Estimate Analysis is generated automatically using information provided by the Builder together with artificial intelligence technologies.

Tecknack Limited does not warrant or guarantee that any AI Estimate Analysis, estimate, recommendation or generated content is accurate, complete, reliable, suitable or free from errors.

Project costs, labour requirements, material quantities, timescales, pricing and other project-specific information may differ significantly from the AI-generated results.

16.3 Builder Verification Required

You are solely responsible for reviewing, verifying and, where necessary, correcting every AI-generated estimate before relying upon it or issuing any Quote or Contract.

You should independently assess all project requirements, measurements, materials, labour costs, applicable regulations and site conditions before making commercial decisions.

16.4 No Professional Advice

The Service does not provide legal, engineering, surveying, architectural, quantity surveying, construction management, financial, tax, insurance or other professional advice.

Nothing generated by the Service should be interpreted as professional advice or as a substitute for independent professional judgement.

16.5 Site Inspections

AI Estimate Analysis is based only on the information supplied to the Service.

The Service cannot determine hidden defects, structural issues, concealed damage, regulatory compliance, safety risks, underground services, site-specific conditions or any other matters that require physical inspection or professional assessment.

16.6 Commercial Decisions

All commercial decisions, including pricing, project scope, labour requirements, material selection, contractual commitments and project execution, remain solely your responsibility.

Artificial intelligence technologies continue to evolve. We may update, replace or improve AI functionality at any time in order to enhance the Service.

Changes to AI functionality may result in different outputs for similar requests over time.

17. Quotes & Contracts Disclaimer

BuildKnack provides tools to assist Builders in preparing editable Quotes and Contract documents. The Service is intended solely to facilitate document preparation and does not replace independent professional judgement or legal advice.

17.1 Editable Documents

All Quotes and Contracts generated by the Service are fully editable by the Builder before they are issued to a Customer.

You are solely responsible for reviewing, amending and approving every document to ensure that it accurately reflects the agreed project requirements and commercial terms.

17.2 No Legal Advice

Tecknack Limited does not provide legal advice, legal representation or legal document review.

Nothing generated by the Service should be interpreted as legal advice or as confirmation that a document is legally valid, enforceable or suitable for your particular circumstances.

17.3 No Solicitor Review

Quotes and Contract templates provided by the Service are not reviewed, approved or certified by a solicitor, lawyer or other legal professional.

If you require legal certainty or advice regarding your contractual documents, you should obtain independent legal advice.

17.4 Compliance with Applicable Law

You are solely responsible for ensuring that every Quote and Contract complies with all applicable laws, regulations and consumer protection requirements in the jurisdiction where the work will be performed.

BuildKnack does not guarantee that any generated document complies with the laws of England and Wales or any other jurisdiction.

17.5 No Party to Your Agreements

Any Quote, Contract or other agreement created using the Service exists solely between the Builder and the Customer.

Tecknack Limited is not a party to those agreements and assumes no responsibility for their negotiation, acceptance, performance, enforcement or interpretation.

17.6 Business Responsibility

You remain solely responsible for all commercial decisions, pricing, project scope, contractual terms, payment arrangements, variations, warranties, guarantees and communications with your Customers.

17.7 Disputes

Tecknack Limited accepts no responsibility for disputes, claims, complaints, delays, losses or disagreements arising between a Builder and a Customer in connection with any Quote, Contract or project.

Any such matters must be resolved directly between the Builder and the Customer.

18. Intellectual Property

All intellectual property rights in BuildKnack and the Service remain the property of Tecknack Limited or its licensors unless expressly stated otherwise.

18.1 Our Intellectual Property

The Service, including its software, source code, user interface, design, layout, functionality, graphics, logos, branding, templates, databases, documentation and other materials, is protected by intellectual property laws.

Except as expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, sell, license, lease, reverse engineer, create derivative works from or otherwise exploit any part of the Service without our prior written permission.

18.2 Your Content

You retain ownership of all Content that you upload, create or generate using the Service, including photographs, project information, customer information, Builder rates, estimates, Quotes and Contracts.

Nothing in these Terms transfers ownership of your Content to Tecknack Limited.

18.3 Licence to Operate the Service

By using the Service, you grant Tecknack Limited a limited, non-exclusive, worldwide, royalty-free licence to host, process, transmit and use your Content solely to the extent reasonably necessary to provide, maintain, secure and support the Service requested by you.

This licence continues only for as long as it is reasonably necessary to provide the Service or to comply with applicable legal obligations.

18.4 Feedback

If you provide suggestions, ideas, feature requests or other feedback relating to the Service, you grant Tecknack Limited the right to use that feedback without restriction or obligation to compensate you.

You acknowledge that providing feedback does not transfer ownership of the Service or create any intellectual property rights in your favour.

You acknowledge that you use the Service entirely at your own risk and remain solely responsible for all professional, commercial and business decisions made using information generated or processed by the Service.

19.2 No Warranty

To the fullest extent permitted by applicable law, the Service is provided on an "as available" and "as is" basis without warranties, guarantees or representations of any kind, whether express or implied.

We do not warrant that the Service will be uninterrupted, error-free, secure or suitable for your particular business requirements.

19.3 AI Estimates, Quotes and Contracts

Tecknack Limited shall not be responsible for any loss, damage, cost or liability arising from your reliance upon AI Estimate Analysis, generated estimates, Quotes, Contract templates or other content produced through the Service.

You remain solely responsible for independently reviewing, verifying, editing and approving all documents before they are used or provided to any Customer or third party.

19.4 Business Decisions

We are not responsible for any pricing decisions, project costs, material quantities, labour calculations, contractual commitments, project delays or other commercial decisions made by you.

19.5 Customer Relationships

Tecknack Limited is not responsible for disputes, claims, complaints, legal proceedings or disagreements between you and your Customers, suppliers, subcontractors or any other third party.

19.6 Indirect Losses

To the fullest extent permitted by applicable law, Tecknack Limited shall not be liable for any indirect, incidental, consequential, special or punitive loss or damage, including loss of profits, loss of revenue, loss of business, loss of opportunity, loss of contracts, loss of goodwill or loss of data.

19.7 Third-Party Services

We are not responsible for failures, interruptions or errors caused by third-party service providers, app stores, payment providers, telecommunications networks, internet services or other systems outside our reasonable control.

19.8 Maximum Liability

To the fullest extent permitted by applicable law, the total aggregate liability of Tecknack Limited arising out of or in connection with the Service or these Terms shall not exceed the total amount paid by you to Tecknack Limited for the use of the Service during the twelve (12) months immediately preceding the event giving rise to the claim.

• your unlawful or fraudulent use of the Service;
• any Quote, Contract or other document issued by you;
• your relationship or dispute with a Customer or other third party;
• your infringement of any intellectual property, privacy or other legal rights of another person; or
• any Content that you upload, create or distribute using the Service.

This indemnity applies only to the extent permitted by applicable law and does not apply where the claim arises directly from our own negligence or wilful misconduct.

21. Suspension & Termination

21.1 Suspension

We may suspend or restrict access to the Service where we reasonably believe that you have breached these Terms, used the Service unlawfully, attempted to circumvent usage restrictions or otherwise compromised the security or integrity of the Service.

21.2 Termination by You

You may stop using the Service and delete your Account at any time using the account management features provided within the Service.

21.3 Termination by Us

We may terminate your access where we reasonably believe that continued access would expose Tecknack Limited, other users or third parties to legal, security or operational risks.

Termination of your Account does not affect any rights, obligations or liabilities that arose before termination.
